A Documentary Film, Q & A Discussion Follows

Out of the Ashes: 9/11 is a documentary film that tells the stories of seven 9/11 families who explore the legal, moral and ethical ramifications of the 9/11 Victim Compensation Fund and its impact on the civil justice system.

Eleven days after the terrorist attack, the federal government put in place the largest public entitlement program, the 9/11 Victim Compensation Fund — to deal with this terrorist tragedy.

Did the 9/11 Fund offer families justice?

If the Victim Compensation Fund was the right thing to do, did those hurt in tragedies like Katrina, Oklahoma City, and other disasters also deserve compensation? Is this Fund, with its methods for calculating the value of a human life, an appropriate remedy & mediation-like model? Was justice delivered?

Spring 2012 Natural Law Colloquium Series:  The Natural Law Origins of the American Right to Privacy

Anita L. Allen is Henry R. Silverman Professor of Law and Professor of Philosophy at the University of Pennsylvania.  She is an expert on privacy law, bioethics, and contemporary values, and is recognized for her scholarship regarding legal philosophy, women’s rights, and race relations.  In 2010 she was appointed by President Obama to the Presidential Commission for the Study of Bioethical Issues.  Her books include Unpopular Privacy:  What Must We Hide (Oxford, 2011); Everyday Ethics:  Opinion-Writing about the Things that Matter Most (Academic Readers/Cognella, 2010); Privacy Law and Society (Thomson/West, 2011); The New Ethics:  A Guided Tour of the 21st Century Moral Landscape (Miramax/Hyperion, 2004); Why Privacy Isn’t Everything:  Feminist Reflections on Personal Accountability (Rowman and Littlefield, 2003); and Uneasy Access:  Privacy for Women in a Free Society (Rowman and Littlefield, 1988).  She has also co-edited (with Milton Regan) Debating Democracy’s Discontent (Oxford, 1998).  Allen, who has written more than a 100 scholarly articles, has also contributed to popular magazines and blogs, and has frequently appeared on nationally broadcast television and radio programs.

Workers Rights Coalition Presents The Take

The Take follows laid off factory workers in the midst of Argentina’s 2001 economic collapse.  The workers struggle to reclaim the factories where they once worked by occupying them and engaging in a prolonged struggle to turn the factories into worker.

Twenty-First Annual Public Interest Student, Alumni, and Faculty Awards Dinner

Public service, long valued at Fordham Law School, is expressed in large part by the annual activities of nearly 500 of our students who participate in some form of pro bono, community service, or advocacy work through the School’s nationally recognized Public Interest Resource Center.  Last year, Fordham Law students volunteered more than 130,000 hours of public service, and more than half of the graduating class devoted 50 or more hours of their time.  The PIRC’s emphasis on student initiated public service broke the mold at the time of its inception in 1991.  Today, the Center continues to set the standard for law schools nationwide by assisting and inspiring those students who seek to be committed to, rather than merely comply with, the spirit of pro bono publico—work for the public good.  PIRC was honored to be the recipient of an 2008 ABA Pro Bono Publico Award.

Environmental Law Advocate Eco-tour of the Bronx River

Please join us on Saturday, March 31st from 10 a.m. to 12 p.m. for an ecotour of the Bronx River hosted by Rocking the Boat, a non-profit organization that teaches South Bronx Youth boat building, maritime skills, and environmental science and restoration.  Read more about them at: http://www.rockingtheboat.org/programs.

The two-hour tour will bring us from Hunts Point Riverside Park north to Concrete Plant Park and south to the mouth of the River. This will be a great opportunity to get outdoors locally and learn about the Bronx River Estuary, a valuable and often overlooked natural resource.

The Historical Enquiries Team has been tasked to re-examine the investigations and circumstances of the deaths of more than 3000 people in Northern Ireland between 1968 and 1998.  The Director of the Historical Enquiries Team, Dave Cox, and his deputy John Brannigan, will speak about how the H.E.T. works to provide as many answers as possible for families, and how it also hopes to identify new evidential opportunities especially where cases remain unresolved.

Philip D. Reed Chair Lecture:  Neal Kaytal – The Solicitor General and Confession of Error:  The Hirabayashi Case

In May 2011, Acting Solicitor General Neal Katyal issued a “confession of error” on behalf of his office, acknowledging that it had failed in its response to the internment of Japanese Americans during World War II.  Katyal stated that the Solicitor General’s office had defended the internment policies, and in doing so had concealed information that undermined a key rationale for internment:  that many Japanese-Americans posed a security threat.  Professor Katyal will speak about the importance of, and the process for, confessions of error by the Solicitor General, within the framework of the Hirabayashi case.

The Crowley Scholars Report Back:  The Cambodia Fact-Finding Trip and the Crowley Experience

The 2012 Noreen E. McNamara Memorial Lecture – Lisa A. Rickard:  The Perils of Commercial Legal Practice:  Ethical and Legal Consequences of Third Party Litigation

Lisa A. Rickard, President, U.S. Chamber Institute for Legal Reform, President, Workforce Freedom Initiative, Executive Vice President, U.S. Chamber of Commerce, will be speaking on the subject “The Perils of Commercial Legal Practice: Ethical and Legal Consequences of Third Party Litigation Funding.”  Third-party litigation funding is the practice of hedge funds and other investment firms, with no connection to a lawsuit, providing funds to pay the lawsuit costs and lawyer’s fees in exchange for a share of the settlement or judgment.  A variation on this practice involves funders who advance living expenses during the pendency of a lawsuit, and are repaid from the proceeds.  These practices are largely unregulated; often involve significant recoveries for the funder at the expense of the claimant; usually are not disclosed to the court or opposing parties; and can result in the funder’s control of strategies and settlement decisions.  Ms. Rickard’s analysis will weigh access to justice considerations against the potential for unethical and abusive practices.

Join Fordham Law Students for Reproductive Justice for a film screening and discussion of the HBO documentary 12th & Delaware.  The documentary features an abortion clinic and a crisis pregnancy center located across the street from each other, and includes interviews of the staff and patients of both organizations.  Following the movie, a discussion will be led by Fordham LSRJ board members and David Benzaquen, Political & Legislative Action Coordinator from NARAL Pro-choice New York.

Law and Information Society Symposium:  Big Data, Big Issues

Over the past few years we have witnessed the growth of a new type of data analysis where computers are able to analyze and use large interconnected databases of information in order to make useful predictions.  This new form of data processing, popularly referred to as “Big Data,” has both benefits and risks.  The public and private sectors are able to use this information aggregation and analysis to create new helpful information sets, but the same data collection and processing also poses threats to individual privacy.  This conference will examine the rise of Big Data and consider how the law can address the privacy concerns without hampering innovation.

Currently enrolled law students may attend the conference for free, but prior registration is encouraged.  Fordham Law School has a financial hardship policy.

In 2008, four animal welfare advocates were arrested as “terrorists” under the Animal Enterprise Terrorism Act for conduct including protesting, chalking the sidewalk, chanting and leafleting, and allegedly using “the Internet to find information on bio-medical researchers.”  Could it happen to you?  Ms. Wilkens will be discussing the AETA and what it means for our First Amendment rights.

Environmental Law Advocates Alternative Break Trip Information Session

The ELA is traveling to Jamaica over spring break to work with the Jamaica Environment Trust (JET).  JET provides legal advice around environmental issues to several communities in Jamaica.  They also do work to preserve and protect natural resources in Jamaica.

Bar Exam Essay Tutorial Program

FOR GRADUATING STUDENTS ONLY.  The law school is offering a two-day interactive tutorial program designed to help you maximize your performance on the essay portion of the New York Bar Exam.  The course will meet from 10 a.m. – 5 p.m. on Sunday, February 12th and Sunday, March 4th in Room 312 of the law school.  Please plan on attending BOTH sessions.  The course is open to all Fordham law students who will be graduating this May.  There is NO charge for this course.

For those students who are unable to attend one or both sessions due to religious observance or class conflicts,  audio recordings will be made of the lectures and will be available for a limited time period following the live lectures; however, you are strongly encouraged to attend the live lectures if at all possible.  Even if you have a conflict for part of the day, please try to attend as much of that day’s lecture as possible.

American Constitution Society Debate on Extrajudicial Killings

The American Constitution Society will host a debate on the controversial topic of extrajudicial killing.  The debate panelists will be:

Philip Alston (Former United Nations Special Rapporteur on Extrajudicial Killing) challenging the domestic and international legality of the existing US approach to targeted killing,

and

John Dehn (Senior Fellow, West Point Center for the Rule of Law) largely supporting the domestic and international legality of the current US approach to targeted killing.

The issue of extrajudicial killing has become particularly contentious in the past year with the questionable legality of the murders of Osama bin Laden and US citizen Anwar al-Awlaki.  This figures to be a very exciting and informative event.

Legal Education and Advocacy Project Information Session

The Legal Education and Advocacy Project (LEAP) will be having an information and orientation session for all potential volunteers, this Thursday, February 2nd, at 12:30PM in room 217.  Please come to learn more about who we are and what we do!

LEAP is:
A group that runs weekly classes for court-involved youth.  The classes focus on practical legal knowledge and critical thinking skills (a ‘Know Your Rights’ type class).  The volunteers travel to alternative-to-detention programs and teach a class based on a lesson plan they create or modify from a previously existing plan.

Time Commitment:
Approximately 2-3 hours a week —  one hour for planning, one for teaching plus transportation time (the location for this semester is on Broadway and Leonard).  YOU CAN ABSOLUTELY DO THIS AS A 1L . . . we did!!!

This semester we will be volunteering at CASES tentatively scheduled for Mondays from 5 – 6 p.m.

Feerick Center Lecture – Steve Choi:  New American Dreams:  Workers Rights and Immigrant Rights in New York

Steven Choi is Executive Director of the MinKwon Center.  A second generation Korean American, Mr. Choi previously was a Program Director at the MinKwon Center and led the Korean Immigrant Workers Rights Project, which provided free direct legal services to low-wage Korean immigrants–the only such project of its kind on the East Coast.  From 2004 to 2007, Mr. Choi served as a Skadden Fellow and Staff Attorney at the Asian American Legal Defense and Education Fund (AALDEF).

The MinKwon Center for Community Action believes that community action–grassroots outreach, community education, leadership development and empowerment, advocacy and mobilization campaigns–is at the heart of what they do.  They focus much of their efforts on the community in Flushing, Queens, the largest Korean American and Asian American community in New York City.  As new arrivals, these immigrant community members face serious language and cultural barriers, legal issues, and disempowerment.  For twenty-five years, the MinKwon Center’s advocacy and community organizing efforts have engaged these community members to find their own long-term, community-led solutions to these problems.

The world of Wall Street traveled to Lincoln Center at the 6th Annual Forum Film Festival with screenings and discussions of Too Big to Fail, the HBO movie about the 2008 economic collapse, with Paul A. Volcker and Andrew Ross Sorkin; Wall Street, the definitive film of insider trading, with Oliver Stone and Edward R. Pressman; and Absence of Malice, with U.S. Attorney Preet Bharara, who that very week concluded the sentencing phase of several high-profile insider trading cases.  Other screenings included the iconic movie about child custody proceedings, Kramer vs. Kramer, with Oscar-winning director and screenwriter Robert Benton, and a rare public appearance by the sons of Julius and Ethel Rosenberg, Michael and Robert Meeropol, who discussed the film Daniel.

Information Session for Muslim Law Students Association Spring Break Advocacy Trip to Haifa and the West Bank

In an effort to promote equality in the Middle East, the Muslim Law Students Association at Fordham University School of Law is organizing an advocacy trip to the Palestinian village of Nabi Saleh in the West Bank.  MLSA is working in conjunction with Adalah Legal Center for Arab Minority Rights in Israel.

The project focuses on the access to water in the villages in Naqab (Negev), a town in the south of Israel.  Eighty-five percent of Naqab is used by Israeli Defense Forces for training purposes.  The remaining part of Naqab is home to over 180,000 Bedouins, who live in thirty-five villages that are not recognized by the Israeli government and therefore are ineligible for municipal services such as connection to the electrical grid, water mains or trash pick up.  Most homes in these unrecognized villages are not connected to a sewage system and suffer from an unreliable water supply.  The Bedouins are not permitted to build permanent structures and thus cannot build a water system on their own.  While there is some progress in the recognition process, the villages are yet to receive water, electricity and garbage services.

In June 2011, the Israeli Supreme Court concluded that the right to water is grounded in the right to dignity.  Nevertheless, the Israeli water authority has not recognized the Supreme Court ruling, claiming that the villages in Naqab are illegal.

Essentially, our project will focus on the issue of the right to water under Israeli and international laws.  The project comprises three major phases:

1.  Conduct research focused on the Israeli and international laws on the right to water and prepare a preliminary research paper prior to leaving New York City;

2.  Fact-finding mission in Naqab Desert:

a. Gather research by interviewing individuals including Bedouin villagers, Israeli authorities, the regional council, lawyers representing the Bedouin citizens of Israel, etc.;
b. Conduct legal research and analysis of the Supreme Court case on the right to water; and
c. Determine the distances of each village from sources of water and living conditions in the unrecognized villages of Naqab by taking photos and recording;

3.  Assemble a final report containing the research findings including the hurdles faced by Naqab Arabs, and an analysis of their rights under Israeli and international law and propose potential solutions to the water problem experienced in the area. The report shall provide a detailed account of the activities of students while on-site.

The fact-finding portion of this project will take place from March 9 – 17, 2012.  The mission is especially well timed as these dates fall in between March 8, International Women’s Day, and March 22, World Water Day, both of which are very significant for our project.

Local health care providers from the Institute for Family Health will prescribe contraception to Fordham students and answer questions about sexual health.  If you need a birth control prescription, all you need to do is have your medical history taken and your blood pressure checked by volunteer medical students and residents before you see the doctor.  In the main room, there will be snacks, free condoms, information and reproductive rights jeopardy!  All are welcome – guys too!  Regardless of your gender or orientation, please join us in solidarity to ensure Fordham students receive appropriate health care and stop by to show your support.

Join the Career Planning Center for a general informational session about the New York City Bar Association Diversity Fellowship, a program that offers first-year day and second-year evening students a unique summer employment opportunity in outstanding law firms, corporate law departments, and government agencies.  CPC staff will discuss the Fellowship application procedures and past Fellowship recipients will be on hand to discuss their experiences and provide advice to potential applicants.
